Under the Department of Homeland Security’s Public Charge Rule, U.S. immigrants who receive non-cash “public benefits,” including most forms of Medicaid, can be denied a green card because they are deemed to be a “public charge.” With the U.S. Supreme Court’s recent order to allow the Final Rule to go into effect while it is being challenged in lower courts, such families, including family members who are exempt from the Rule, and U.S. citizens, are afraid to use public benefits that they are entitled to.
